{"id":12875,"date":"2023-07-26T11:00:00","date_gmt":"2023-07-26T10:00:00","guid":{"rendered":"https:\/\/newsmediauk.org\/?p=12875"},"modified":"2024-05-03T10:23:52","modified_gmt":"2024-05-03T09:23:52","slug":"nma-welcomes-peers-recommendation-to-maintain-judicial-review-standard-for-appeals-in-digital-markets-competition-and-consumers-bill","status":"publish","type":"post","link":"https:\/\/newsmediauk.org\/blog\/2023\/07\/26\/nma-welcomes-peers-recommendation-to-maintain-judicial-review-standard-for-appeals-in-digital-markets-competition-and-consumers-bill\/","title":{"rendered":"NMA Welcomes Peers\u2019 Recommendation To Maintain Judicial Review Standard For Appeals In DMCC Bill"},"content":{"rendered":"\n<p>The News Media Association has welcomed the Lords Communications and Digital Committee\u2019s recommendation to government that two critical mechanisms within the Digital Markets, Competition and Consumers Bill &#8211; the judicial review appeals standard and the threshold for big tech to access the countervailing benefits exemption \u2013 must not be watered down.&nbsp;<\/p>\n\n\n\n<p>NMA chief executive Owen Meredith said: \u201cWe strongly welcome the Committee\u2019s clear and explicit recommendation that judicial review is the appropriate standard for appeals against Competition and Markets Authority regulatory decisions and should not be changed to full merits appeals or judicial review-plus.&nbsp;Maintaining the judicial review standard is critical to the success of the new regime.<\/p>\n\n\n\n<p>\u201cWe also welcome the Committee\u2019s conclusion that government \u2018should resist any changes that would lower the threshold\u2019 to access the countervailing benefits exemption. If widened, the exemption could give big tech a \u2018get out of jail free card\u2019 for anti-competitive conduct.<\/p>\n\n\n\n<p>\u201cIt is vital to the success of the new regime that these critical mechanisms within the Digital Markets, Competition and Consumers Bill are not watered down, so the Bill can deliver on its core objective of unlocking the full potential of the UK digital markets.\u201d<\/p>\n\n\n\n<p>Owen\u2019s evidence is quoted extensively in the letter <a href=\"committees.parliament.uk\/publications\/41026\/documents\/199836\/default\/\">Committee\u2019s letter to Business Secretary Kemi Badenoch MP<\/a>. <\/p>\n\n\n\n<p>On the issue of tackling anti-competitive leveraging behaviour, Owen was quoted as saying: \u201cThe CMA should be able to act where a designated company\u2019s activity in a non-designated area is related to a harm that is being caused in that area.
